The use of this mobile application is subject to the Terms of Use as detailed below in conjunction with our standard Terms and Conditions for the supply of services which together constitute the full agreement between you the customer and ourselves. By using this application you acknowledge that you have read, accepted and agreed to be bound by both of these sets of Terms and Conditions.
It is recommended that you should be at least 18 years of age, that you may have the power to enter into this agreement and you acknowledge that this agreement creates binding and valid legal obligations upon you.
If you do not agree with or do not wish to accept the Terms and Conditions relating to this mobile application, then please do not use this mobile application or service. You are also advised that failure to accept our Terms and Conditions may result in your inability to access certain sections of this application.
FixDar is a platform that connects individuals seeking to obtain services (customers) with individuals seeking to provide services (workers). Hereinafter, individuals seeking to obtain services are referred to as “Customers”, individual seeking to provide services as “Workers”. Customers and workers together are hereinafter referred to as “Users. Those certain services requested by the customers, which are to be completed by the workers are hereinafter referred to as “Services.”
FixDar is a communications platform for enabling connection between Users. FixDar does not take part in the interaction between Users. FixDar does not have control over the quality, timing, legality, failure to provide, or any other aspect whatsoever of any Services provided by workers, nor of the integrity, responsibility or any of the actions or omissions whatsoever of any Users. FixDar does not have control over the quality, timing or legality of Services delivered by workers in the system. FixDar makes no representations about the suitability, reliability, timeliness, or accuracy of the Services requested and provided by Users identified through the Service whether in public, private, or offline interactions.
FIXDAR CANNOT CONFIRM THAT EACH USER IS WHO THEY CLAIM TO BE. FIXDAR DOES NOT ASSUME ANY RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF THIS INFORMATION OR ANY INFORMATION ON THE SERVICE. NEITHER FIXDAR NOR ITS AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. FIXDAR AND ITS AFFILIATES AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE.
Only you are authorized user of your account and your password would be kept confidential, so solely you are responsible for all the activities that occur using your account. FIXDAR will not have any control over your account and clearly disclaims any liability derived. In case of any suspect in your account or you may find someone else using your account, you are responsible to contact FIXDAR immediately.
By using the Application or Service, you expressly represent and warrant that you are legally entitled to enter this Agreement. If you reside in a jurisdiction that restricts the use of the Service because of age, or restricts the ability to enter into agreements such as this one due to age, you must abide by such age limits and you must not use the Application or Service. By using the Application or the Service, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement. Your participation in using the Service and/or Application is for your personal use and the use of others that have explicitly authorized you. You may not authorize others to use your user status, and you may not assign or otherwise transfer your user account to any other person or entity. When using the Application or Service you agree to comply with all applicable laws from your home nation, the country, state and city in which you are present while using the Application or Service. The Company reserves the right to terminate this Agreement if you use the Service or Application with an incompatible or unauthorized device. By using the Application or the Service, you agree that:
When you request us to make contact we may collect personal information supplied by you and You are solely responsible for Your Information, and we act merely as a passive conduit for your online distribution and publication of Your Information. Such information will enable us to process your communication efficiently. So you hereby represent and warrant to FixDar that Your Information
We will only release information about you as authorized by yourself, required by law or where required in order for us to communicate with yourself. Where supplied to third parties the information provided will only be sufficient for the third party to perform their services and may not be used by them for any other purpose.
We will not release your information for any purpose which you could reasonably expect us not to release the information.
Except as detailed above we do not share, give, sell, rent, or lease information to third parties and your personal information will only be disclosed to those employees within our organization who have a need to know in order to ensure you are provided with information about our services through this application
FixDar is not responsible regarding the contract agreement between customers and workers and also its payment agreement. FixDar is just a source of medium between customers and professional service providers (workers). Once a service is completed, it will be marked as closed immediately, so customers must give access to their properties in their own supervision to avoid any acute circumstances, FixDar will not be responsible for any loss or damaged caused in any scenario by the worker or by customer himself/herself. The Customer shall inspect the Works as far as it is reasonably possible to do so immediately upon their completion.
If there is any labour warranty given by FixDar, it precisely means warranty valid for specifically labour for a limited time set by FixDar starting from the completion time of the work/job do by the worker. It is clearly defined FixDar will NOT be responsible for any warranty, responsibility, damaged or loss for the material of any work/job done by the worker. In addition labour warranty will NOT be valid if there has been any damaged or loss caused by the customer on the work/job done by the worker. Warranty will only be valid for the time dictated by FixDar and it must be claimed by customer by emailing at management@fixdar.com.
Customers using the services are obligated to pay for the services they ordered, unless specifically notified otherwise. For all purchases and payments for reimbursement costs, fees or expenses associated with a Service, FixDar will charge you cash amount according to the amount agreed upon between you and FixDar for the use of the services, and you hereby authorize us to charge you for such amounts. No refunds will be provided once the customer has been charged. You will be liable for all transaction taxes on the services provided under this Agreement
The contents of this application are at all times the copyright or trademark property of either FixDar, FixDar’s suppliers or linked third parties and you may not distribute, reproduce, display, publish any trademark or other content of this mobile app for any purpose whatsoever without the prior written approval of FixDar.
In case of any kind of dispute, you are requested to email at the email address of FixDar within 3 days of availing the service. The email address of FixDar is management@fixdar.com. Notify the issue at this email address and FixDar will get back to you soon. If you and FixDar are unable to resolve a Dispute through negotiations over mail, either you or FixDar may elect to have the Dispute finally and exclusively resolved by binding arbitration. Any election to arbitrate by one party will be final and binding on the other. YOU UNDERSTAND THAT IF EITHER PARTY ELECTS TO ARBITRATE, NEITHER PARTY WILL HAVE THE RIGHT TO SUE IN COURT OR HAVE A TRIAL.
FixDar is not liable for any injury, harm or death caused to anyone, customer, worker or any other party in any scenario or situation, as FixDar is a mere platform that connects users. FixDar accepts no liability to any user for any loss or damage of any user, whether foreseeable or otherwise.
To facilitate its customers, FixDar may introduce certain promotional opportunities time to time. And the time limit of such promotion will be in total control of FixDar and it may discontinue without any advance notice. Some codes maybe just valid for specific customers so claim regarding those would not be acceptable.
The display on our application of any advertiser or the provision of a link to third party mobile app does not constitute our endorsement of either the advertiser or third party provider or any of their content or business practices. As we do not have any control of the content of any third party application, access to such mobile application is at your sole risk.
We shall accept no liability in regards to any dealings, promotions or activities between yourself and advertisers or workers.
Specifications and information provided on this mobile application are given in good faith based on our knowledge, experience, or information provided to us by manufacturers and/or suppliers, or derived from sources believed to be accurate at the time the information is received by us.
Due to the inherent nature of applications we cannot guarantee uninterrupted or continuous availability of this mobile app and you accept that the application may also be unavailable from time to time for maintenance or scheduled upgrades. Where able, we shall give you advanced warning of the same. We shall accept no liability in relation to mobile application downtime whether scheduled or otherwise.
FixDar may amend this Agreement from time to time. Amendments will be effective upon FixDar’s posting of an updated Agreement at this location. Your continued access or use of the application Platform after such posting constitutes your consent to be bound by this Agreement, as amended.
If any provision set out in these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions shall not be effected. These Terms and Conditions shall be governed and construed in accordance with the laws of the Islamic Republic of Pakistan
